Welcome to Mercy & Mending.
Mercy & Mending is a trade name operated by Gina Mae Brewer-Mills, a sole proprietor located in Colorado, United States. Throughout these Terms of Service, “Mercy & Mending,” “we,” “us,” and “our” refer to Gina Mae Brewer-Mills doing business as Mercy & Mending.
Mercy & Mending operates this website and online store, including its information, content, features, tools, digital products, and related services, collectively referred to as the “Services.” Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with our Privacy Policy, Return and Refund Policy, and any additional terms displayed in connection with a particular product or promotion, describe your rights and responsibilities when you access or use the Services.
Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.
By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you should not access or use the Services.
Nothing in these Terms excludes, restricts, or replaces any consumer right or remedy that cannot legally be excluded under the laws applicable to your purchase.
SECTION 1 — ELIGIBILITY, ACCESS, AND ACCOUNTS
You must be at least the age of majority in your state, province, territory, or country of residence to make a purchase through the Services.
If you permit a minor dependent to access or use the Services on a device you own or manage, you accept responsibility for supervising that use. Digital products addressing sensitive personal, relational, spiritual, or emotional subjects are intended for use with appropriate adult guidance where applicable.
You may be asked to provide information such as your name, email address, billing address, payment information, and other information necessary to complete your purchase or provide the Services.
You represent that the information you provide is accurate, current, and complete and that you have the right to provide it.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. You may not sell, assign, license, or transfer your account to another person.
We reserve the right to refuse service, suspend an account, cancel an order, or restrict access when reasonably necessary to prevent fraud, unlawful activity, security risks, misuse of the Services, or violations of these Terms.
SECTION 2 — PRODUCTS AND PRODUCT INFORMATION
Mercy & Mending primarily offers downloadable or electronically accessible digital products, which may include ebooks, workbooks, journals, devotionals, Scripture cards, templates, studies, guides, and similar resources.
We make reasonable efforts to describe our products accurately, including their content, file format, dimensions, compatibility, and intended use. Product images and mockups may be illustrative. Colors and appearance may differ depending on your screen, printer, paper, ink, software, and device settings.
Unless a product description expressly states otherwise, the purchase of a digital product does not include a printed or physical item.
Please review the product description and technical requirements before purchasing. You are responsible for confirming that you have a compatible device, software, printer, internet connection, and other resources needed to access or use the product when those requirements have been disclosed.
We may update, revise, discontinue, or limit a product at any time. Changes will not reduce any mandatory rights associated with a purchase already completed.
Product-specific terms, license terms, or disclosures displayed on a product page form part of these Terms. If product-specific terms conflict with these general Terms, the product-specific terms will govern for that product, except where prohibited by law.
SECTION 3 — FAITH, EDUCATIONAL, AND WELLNESS DISCLAIMER
Mercy & Mending provides faith-centered educational and inspirational resources for personal reflection, encouragement, spiritual growth, and general informational purposes.
Our products and Services are not medical, psychological, psychiatric, therapeutic, legal, financial, crisis-intervention, or other professional advice. They are not a substitute for diagnosis, treatment, counseling, legal advice, individualized pastoral care, or assistance from a qualified professional.
Purchasing or using a Mercy & Mending product does not create a therapist-client, counselor-client, attorney-client, clergy-penitent, fiduciary, or other professional relationship.
You are responsible for deciding whether a product is appropriate for your circumstances. If you are experiencing abuse, immediate danger, a medical or mental-health emergency, or thoughts of harming yourself or another person, contact qualified local professionals or emergency services in your location.
Our resources may discuss faith, healing, difficult relationships, grief, identity, boundaries, restoration, and personal growth. Individual experiences differ, and we do not promise or guarantee any particular spiritual, emotional, relational, financial, health, or personal outcome.
Biblical quotations, commentary, reflections, and interpretations are presented for general faith-based education and encouragement. They should not be treated as the only possible theological interpretation or as individualized pastoral guidance.
SECTION 4 — ORDERS AND ACCEPTANCE
When you submit an order, you are making an offer to purchase the selected product under these Terms.
Your order is accepted when we process your payment and send an order confirmation or begin digital delivery. An automatically generated acknowledgment does not require us to accept an order if payment fails, the product is unavailable, the order appears fraudulent, or an error materially affects the transaction.
Please review your order, email address, product selection, format, and price carefully before submitting it. Because digital delivery may begin immediately, we may be unable to cancel an order after it has been accepted or delivery has started.
We may refuse, limit, or cancel an order for legitimate reasons, including suspected fraud, unauthorized payment activity, pricing or product errors, unlawful activity, sanctions restrictions, product availability, or violation of these Terms.
If we cancel an order after payment has been collected and no product is provided, we will refund the applicable amount.
Purchases are subject to our Return and Refund Policy, which is incorporated into these Terms.
SECTION 5 — PRICES, CURRENCIES, TAXES, AND PAYMENT
Prices, discounts, and promotions may change without notice. The price charged will be the price displayed at checkout when the order is submitted, subject to correction of obvious errors.
The currency displayed may depend on your location or store settings. Your bank, card issuer, or payment provider may apply exchange rates, international transaction charges, or other fees that we do not control.
Applicable sales tax, value-added tax, goods and services tax, or similar charges may be calculated and displayed at checkout where required. You are responsible for taxes or charges legally payable by you that are not collected at checkout.
Because our current products are delivered digitally, physical shipping charges and customs duties generally do not apply unless a product page expressly identifies an item as physical.
You agree to provide accurate and complete billing and payment information. You represent that you are authorized to use the payment method submitted and that the payment information is valid.
We may use Shopify and other payment providers to process transactions. We do not directly receive or store complete payment-card details when they are handled by those providers.
SECTION 6 — DIGITAL DELIVERY AND ACCESS
Digital products are generally delivered through an email, customer account, download page, or other electronic access method.
You are responsible for providing an accurate email address and checking spam, junk, promotions, and similar folders. If you enter an incorrect email address, contact us so we can attempt to correct it and resend delivery.
Delivery times are estimates unless applicable law requires otherwise. Most digital products are delivered shortly after successful payment, but fraud screening, payment authorization, system maintenance, internet disruptions, or circumstances outside our reasonable control may delay delivery.
Download links may expire, have download limits, or be subject to other technical controls. You should download and securely store your purchased files promptly.
If you experience a missing email, broken link, corrupted file, incomplete delivery, or other access problem, contact us at mercyandmending@gmail.com. We may verify order, fulfillment, delivery, and download records while investigating the problem.
Our procedures for delivery failures, incorrect files, duplicate purchases, and approved refunds are described in our Return and Refund Policy.
SECTION 7 — DIGITAL PRODUCT LICENSE
Unless a product page or separate license expressly states otherwise, purchasing a digital product grants you a limited, non-exclusive, non-transferable, revocable license to use that product for your personal, noncommercial use.
You may:

Download the product to your personal devices;

Create reasonable backup copies for your own use;

Print reasonable copies for your own personal or household use; and

Use the product for personal reflection, study, journaling, prayer, or other personal purposes consistent with its description.
You may not, without our prior written permission:

Share, forward, distribute, sublicense, rent, lend, sell, or resell a digital product;

Give copies or download access to friends, clients, group members, organizations, or other third parties;

Upload the product to a shared drive, membership platform, social media platform, file-sharing service, website, marketplace, or public database;

Reproduce the product for a class, church, ministry, counseling practice, support group, business, commercial program, or organization unless the applicable license expressly permits that use;

Modify, translate, adapt, rebrand, or create derivative products for distribution or sale;

Remove copyright, trademark, attribution, or proprietary notices;

Claim the product or any portion of it as your own work;
-
Use the product to create a competing product;
-
Use our content to train an artificial-intelligence system, machine-learning model, dataset, or content-generation system; or
-
Use the product for any unlawful, deceptive, infringing, or commercial purpose.
Purchasing a product does not transfer ownership of its copyright, trademarks, designs, or other intellectual-property rights.
If you need a group, ministry, church, classroom, professional, or commercial license, contact us before distributing or reproducing the material.
SECTION 8 — INTELLECTUAL PROPERTY
The Services and their contents—including our names, trademarks, logos, designs, photographs, graphics, illustrations, text, product content, downloadable materials, videos, audio, layout, and arrangement—are owned by or licensed to Mercy & Mending and are protected by United States and international intellectual-property laws.
Our name, Mercy & Mending, our logos, product names, designs, slogans, and brand elements may not be used without prior written permission.
Except for the limited digital-product license granted in Section 7, these Terms do not grant you any ownership interest or license in our intellectual property.
You may access and use the public portions of the website for lawful, personal, noncommercial purposes. You may not scrape, reproduce, republish, distribute, modify, publicly display, exploit, or transmit website materials without permission, except as permitted by law.
Shopify’s names, logos, product names, designs, and slogans are trademarks of Shopify. Other names and marks appearing through the Services belong to their respective owners.
SECTION 9 — RETURNS, CANCELLATIONS, AND REFUNDS
Digital purchases are generally final after delivery, downloading, or access begins, except in cases covered by our Return and Refund Policy or when a remedy is required by applicable law.
Customers in jurisdictions that provide a statutory cancellation or withdrawal period may have additional rights.
For paid digital content supplied immediately to consumers in the European Union, European Economic Area, or United Kingdom, we may request your prior express consent to begin delivery during the applicable cancellation period and your acknowledgment that your cancellation or withdrawal right may be lost once delivery or access begins.
Your mandatory rights concerning faulty, corrupted, incomplete, incorrectly described, or undelivered digital content remain unaffected.

SECTION 10 — INTERNATIONAL ACCESS AND LEGAL COMPLIANCE
The Services may be accessed from locations around the world. We do not represent that every product or feature is lawful, appropriate, or available in every jurisdiction.
You are responsible for complying with laws applicable to your access and use of the Services.
We may restrict products, payment methods, promotions, or access in particular countries or regions where necessary to comply with sanctions, export controls, payment-provider requirements, licensing restrictions, tax obligations, or other applicable laws.
You may not purchase from or use the Services in a manner that would cause us, Shopify, a payment provider, or another service provider to violate applicable sanctions, export controls, or trade restrictions.
Nothing in these Terms limits consumer rights that cannot lawfully be waived. If a mandatory consumer-protection law applicable to your purchase conflicts with these Terms, the mandatory law will control to the extent of that conflict.
SECTION 11 — THIRD-PARTY TOOLS AND SERVICES
The Services may provide access to tools, applications, payment services, embedded features, or resources operated by third parties.
We do not control all third-party tools and generally provide access to them “as is” and “as available.” Your use of a third-party service may be governed by that provider’s terms and privacy policy.
We are not responsible for third-party services to the extent permitted by law. You should review the applicable provider’s terms before using an optional third-party tool.
We may add, change, or discontinue tools and features. New features offered through the Services will generally be subject to these Terms.
SECTION 12 — THIRD-PARTY LINKS
The Services may contain links to websites or materials operated by third parties. We do not control and are not responsible for the content, accuracy, availability, security, or practices of third-party websites.
If you follow a third-party link, you do so at your discretion. Review that third party’s terms, policies, and practices before providing personal information or completing a transaction.
Questions or complaints concerning third-party products and services should be directed to the applicable third party, except where applicable law gives you a remedy against us.
SECTION 13 — RELATIONSHIP WITH SHOPIFY
Mercy & Mending is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Mercy & Mending.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Mercy & Mending, including any injury, damage, or loss resulting from purchased products and services.
To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions made directly with Mercy & Mending.
SECTION 14 — PRIVACY
Personal information collected through the Services is handled as described in our Privacy Policy.
Because Shopify hosts the Services, Shopify may collect and process personal information concerning your access to and use of the Services. Information submitted through the Services may be transmitted to Shopify and other service providers, including providers located outside your country.
Shopify’s processing of personal information is also subject to its applicable privacy terms and policies.
Please review our Privacy Policy for more information about how we and our service providers collect, use, disclose, retain, and protect personal information and how you may exercise applicable privacy rights.
SECTION 15 — FEEDBACK, REVIEWS, AND SUBMISSIONS
If you voluntarily submit a product review, testimonial, suggestion, idea, photograph, comment, or other content to us, you represent that you own or have permission to submit it and that it does not violate another person’s rights.
Unless we agree otherwise in writing, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to reproduce, edit, publish, display, distribute, and use that submission in connection with operating, improving, and promoting Mercy & Mending and the Services.
This license does not transfer ownership of your original content to us.
You may not submit content that is unlawful, infringing, deceptive, defamatory, threatening, abusive, obscene, malicious, or that contains malware or another person’s confidential or personal information without authorization.
If a review or testimonial was submitted in exchange for compensation, a free product, a discount, or another incentive, you must disclose that relationship.
We may moderate or remove submissions that violate these Terms or applicable law, but we are not obligated to monitor every submission.
SECTION 16 — ERRORS, INACCURACIES, AND OMISSIONS
Occasionally, the Services may contain typographical errors, inaccuracies, or omissions involving product descriptions, prices, promotions, availability, compatibility, taxes, or other information.
We may correct errors, update information, or cancel an affected order when reasonably necessary. If we cancel an order because of our error after collecting payment, we will refund the applicable amount.
Nothing in this section limits a mandatory consumer right or permits us to change an accepted contract where prohibited by law.
SECTION 17 — PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to:

Interfere with the security, operation, functionality, or availability of the Services;

Circumvent access controls, download limits, security features, or anti-fraud measures;

Scrape, crawl, extract, copy, reproduce, sell, or exploit the Services or their content without authorization;

Use automated systems in a manner that imposes an unreasonable burden on the Services;

Make fraudulent purchases, initiate abusive payment disputes, or misuse promotional offers; or

Engage in conduct that harms Mercy & Mending, Shopify, our service providers, or other users.
We may suspend or terminate access if we reasonably believe these Terms have been violated.
SECTION 18 — AUTOMATED AGENTS
This section applies if you deploy or permit autonomous or semi-autonomous software, an artificial-intelligence agent, bot, crawler, or similar automated system to access or interact with the Services.
Automated agents must accurately identify themselves, comply with applicable technical instructions, and must not conceal their automated nature, imitate human behavior to evade detection, bypass CAPTCHAs, circumvent access restrictions, or disregard a request to stop accessing the Services.
We may use technical measures to limit or block automated access.
This section does not prohibit ordinary accessibility technology, search-engine indexing that follows our published instructions, or uses protected by applicable law.
SECTION 19 — TERMINATION
You may stop using the Services at any time.
We may suspend or terminate your access when reasonably necessary because of a violation of these Terms, unlawful conduct, security risk, fraud, misuse, or discontinuation of the Services.
Termination does not eliminate payment obligations or liabilities that arose before termination.
Sections concerning intellectual property, product licenses, privacy, feedback, disclaimers, liability, indemnification, governing law, and other provisions that by their nature should survive will remain effective after termination.
SECTION 20 — DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Services and products are provided “as is” and “as available,” except for warranties or guarantees expressly stated by us or imposed by law.
We do not guarantee that the Services will always be uninterrupted, timely, secure, compatible with every device, or error-free.
We do not guarantee that educational, inspirational, faith-centered, or reflective resources will produce a particular result.
Some jurisdictions do not permit the exclusion of certain warranties, guarantees, or conditions. In those jurisdictions, this section applies only to the extent legally permitted.
Nothing in these Terms excludes warranties, consumer guarantees, or remedies that cannot lawfully be excluded, including applicable rights relating to digital content that is faulty, incorrectly described, or not supplied as agreed.
SECTION 21 — LIMITATION OF LIABILITY
To the fullest extent permitted by law, Mercy & Mending and our service providers, licensors, contractors, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from the Services or a product, including loss of profits, revenue, business opportunity, data, goodwill, or anticipated savings.
To the fullest extent permitted by law, our total liability arising from a particular purchase will not exceed the amount you paid for the product giving rise to the claim.
These limitations do not apply where liability cannot legally be limited or excluded. Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where applicable, or a mandatory consumer remedy.
SECTION 22 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Mercy & Mending, Shopify, and our respective service providers, licensors, contractors, and representatives from third-party claims, losses, or reasonable expenses arising directly from:

Your infringement of another person’s intellectual-property, privacy, or other legal rights; or

Your unauthorized distribution or commercial exploitation of our digital products.
This section does not require a consumer to indemnify us for our own unlawful conduct, negligence, or breach of contract and does not apply where prohibited by consumer law.
SECTION 23 — SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the greatest extent permitted or severed to the minimum extent necessary.
The remaining provisions will continue in effect.
SECTION 24 — WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce a right under these Terms does not waive that right.
These Terms, together with our Privacy Policy, Return and Refund Policy, product-specific terms, and other policies expressly incorporated into them, form the agreement between you and Mercy & Mending concerning the Services.
They supersede prior communications concerning the same subject, except where applicable law provides otherwise.
SECTION 25 — ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written permission.
We may assign or transfer our rights and obligations in connection with a sale, transfer, restructuring, or reorganization of the business, provided that doing so does not reduce mandatory consumer rights.
SECTION 26 — GOVERNING LAW AND DISPUTES
These Terms and transactions with Mercy & Mending are governed by the laws of the State of Colorado and applicable United States federal law, without regard to conflict-of-law principles.
Subject to mandatory consumer rights, legal proceedings relating to these Terms or the Services may be brought in the state or federal courts with jurisdiction in Colorado, and the parties consent to the jurisdiction of those courts.
If you are a consumer outside the United States, this choice of law does not deprive you of mandatory protections available under the laws of your habitual residence. You may also have the right to bring a dispute in the courts or use a consumer-dispute process available in your home jurisdiction.
Before filing a formal claim, we encourage you to contact us at mercyandmending@gmail.com so we can attempt to resolve the matter informally. This does not prevent you from exercising a legal right or meeting a legal deadline.
SECTION 27 — CHANGES TO THESE TERMS
You can review the current version of these Terms on this page.
We may update these Terms to reflect changes to our Services, products, technology, business practices, or legal obligations.
Material changes will be communicated as required by applicable law. Updated Terms will become effective on the date stated in the revised version.
Changes will not retroactively reduce rights relating to an order already accepted where prohibited by law.
